01 Agreeing to these terms

These terms are an agreement between you and Vikas Tikyani, the developer and operator of WheyGPT (“the app”, “we”, “us”). By creating an account or using the app, you accept them. If you don’t agree with something here, the honest advice is not to use the app, and to email support@wheygpt.app so we can hear why.

02 Who can use WheyGPT

WheyGPT is designed for adults, and GLP‑1 medications are prescribed to adults. You must be at least 18 years old (or the age of majority where you live) to create an account. By using the app you confirm that you meet this requirement.

03 What WheyGPT is, and importantly, what it is not

WheyGPT helps you track protein and nutrition, set targets, and get AI‑powered suggestions. That’s it, and that’s a lot. But to be completely clear:

• WheyGPT is not medical advice, and it is not a medical device. It does not diagnose, treat, cure, or prevent any condition.
• Targets and suggestions are general nutrition information, calculated from the profile you provide. They are a starting point, not a prescription.
• Nothing in the app replaces your doctor, your prescriber, or a registered dietitian. Decisions about medication, diet changes, and your health plan belong with you and your care team.
• If something feels wrong with your health, contact a medical professional, not a protein app.

04 AI features and their limits

Photo analysis and the protein coach are powered by AI language models. They are genuinely useful and sometimes wrong:

• Nutrition numbers from photos are estimates. Portion sizes, hidden ingredients, and unusual dishes can throw them off. You can and should adjust entries that look wrong.
• Coach answers are generated in the moment and can contain mistakes. Treat them as informed suggestions, not facts about your body.
• AI output is provided for information only and is not professional advice of any kind.

05 Your account

Keep your sign‑in credentials to yourself, and give us accurate information, since your targets are calculated from it. You’re responsible for activity on your account. If you suspect someone else is using it, change your password in the app or contact us.

06 Subscriptions, the free trial, and billing

WheyGPT Pro unlocks the full app: AI photo logging, protein coaching, Reminders, weight tracking, and unlimited chat.

• Plans and prices. $5.99 per month or $23.99 per year (US pricing). Prices in other regions and any future price changes are always shown by Apple before you confirm.
• Free trial. New subscribers get a 3‑day free trial with full access. When the trial ends, it converts to the paid plan you picked, automatically.
• Auto‑renewal. Subscriptions renew automatically at the end of each period. Your Apple ID is charged within 24 hours before the new period starts.
• Cancelling. Cancel anytime in your iPhone settings: Settings → your name → Subscriptions → WheyGPT. To avoid being charged, cancel at least 24 hours before the trial or current period ends. After cancelling you keep access until the period you paid for runs out.
• Billing is handled by Apple. All payments, and any refund requests, go through Apple, not us. You can request a refund from Apple at reportaproblem.apple.com.
• Restoring. Reinstalled the app or got a new phone? Use “Restore purchases” to bring your subscription back.

07 Your content

The photos you take, the meals you log, and the messages you send stay yours. You give us permission to store and process them for one purpose: running the app’s features for you (analyzing photos, generating coach answers, calculating progress). How that data is handled and how to delete it is covered in the privacy policy.

08 Fair use

Don’t abuse the app. Specifically, you agree not to:

• Reverse engineer, copy, or resell the app or its AI features.
• Use the coach or photo analysis for anything unlawful, or try to extract other people’s data.
• Flood the AI features with automated or bulk requests. “Unlimited chat” means unlimited human use, not a free API.
• Use a false identity on the leaderboard or impersonate anyone.

We can suspend or close accounts that break these rules, with a refund handled per Apple’s policies.

09 Our content

The app, this website, the WheyGPT name, the design, and Pip the mascot are our intellectual property. We give you a personal, non‑transferable license to use the app on your Apple devices. Please don’t use our brand or Pip commercially without asking first.

10 Third‑party services

The app relies on third‑party services: Apple for sign‑in and billing, Supabase for data storage, RevenueCat for subscription management, and AI model providers for analysis and chat. Their availability affects the app’s availability, and their terms govern their services.

11 The Apple part

Because WheyGPT is distributed through the App Store:

• These terms are between you and us, not with Apple. Apple has no obligation to provide maintenance or support for the app.
• In case of any failure of the app to conform to a warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• Apple is not responsible for handling any claims relating to the app (product liability, regulatory compliance, consumer protection or similar).
• Apple and its subsidiaries are third‑party beneficiaries of these terms and may enforce them against you.
• You confirm you’re not in a country under a US government embargo and not on any US government restricted‑party list.

12 Warranties and liability, in plain English

WheyGPT is provided “as is”. We work hard to keep it accurate, fast, and available, but we can’t promise it will always be error‑free or uninterrupted, and we make no warranties beyond what the law requires.

To the maximum extent the law allows: we are not liable for indirect or consequential damages (like lost data caused by events outside our control, or decisions you make based on app content), and our total liability for any claim is capped at the amount you paid for the app in the 12 months before the claim. Nothing in these terms removes rights that consumer law guarantees you in your country.

13 Ending things

You can stop using WheyGPT anytime, and delete your account and data from Settings inside the app (remember to also cancel your subscription with Apple, since deleting the account doesn’t cancel billing). We can suspend or terminate accounts that violate these terms. Sections that by their nature should survive (like liability limits and IP) survive termination.

14 Changes to these terms

If we change these terms, the new version is posted here with an updated date, and meaningful changes will be announced in the app. Continuing to use the app after a change means you accept the new terms.
